The Abu Dhabi Court of Cassation has upheld a lower court ruling denying a woman’s request for Dh505,000 in additional compensation from an insurance company, affirming that a claimant cannot receive two payouts for the same incident. The woman had sought compensation for damage to her car and two electric wheelchairs used by her husband and mother, both persons of determination, following a traffic accident. She requested coverage for repairs, replacement of the wheelchairs, and caregiver expenses, as well as damages for emotional and material harm. Her claim was initially rejected by the Insurance Dispute Settlement and Resolution Committee, and subsequent appeals to the first instance court and the Court of Cassation were also dismissed. The court emphasized that she had already received Dh107,000 for repairs to the car and wheelchairs, along with Dh126,000 for wheelchair-related damages via her legal representative. The court reinforced the principle that a victim cannot be compensated twice for the same losses arising from a single incident.
